US Supreme Court Agrees to Hear NFL Antitrust Case

The Supreme Court on Monday agreed to take up an antitrust case brought against the NFL over its current apparel licensing agreement with Reebok. American Needle Inc. of Buffalo, NY has challenged the deal. The company had been one of many companies that had been licensed to provide official NFL headgear until the NFL gave exclusive rights to Reebok in 2001.
A lower appeals court had ruled for the NFL, but the NFL has also asked the high court to hear the case to help eliminate more costly, and in the NFL's opinion frivolous, cases. The core of the case is whether the league can act collectively or should have to act as 32 separate businesses. The NBA and NHL have interest in the case as the decision would reach into their organizations. MLB has an antitrust exemption and therefore is not affected by the court's ruling.
The court is expected to hear the case in late this year or early in 2010.
